Terms of service

1. Accepting these terms

By creating an account or using any part of Xyranik, you confirm that you have read and agree to these terms and to our Privacy policy.

2. What the service is

Xyranik reads the data you connect, proposes work for your approval, carries out what you approve through the channels you have connected, and measures what came of it. We may change or discontinue parts of the service; where a change materially reduces what you have paid for, we will tell you before it takes effect.

3. Your responsibilities

• Keeping your account credentials secure.
• Everything done under your account.
• Having the right to contact the people whose details you upload, and complying with the laws that apply to marketing in your country and theirs.
• The accuracy of the information you give us.

4. Your licence to use Xyranik

Subject to these terms, FactoFlare AI grants you a limited, non-exclusive, non-transferable right to use Xyranik for your own business purposes for as long as your account is in good standing.

5. Your data

The contacts, orders, messages and results inside your workspace remain yours. We do not sell them and we do not share them with other customers. Your use of the service is also governed by our Privacy policy, and the protections in place — and those not yet in place — are described on the Security page.

6. Plans and payment

• Every new account begins with a 14-day evaluation and no card. When it ends, your data stays and can still be exported, but sending and generating need a paid plan.
• Paid plans are billed monthly or yearly in advance, through Stripe. Your card details go to Stripe and never reach Xyranik.
• Some plans include a trial the first time you subscribe. Sending volumes are capped during a trial until the first payment succeeds.
• Nothing beyond your plan is charged automatically. Sending and generating stop at your plan’s monthly allowance. If you need more, you buy it deliberately, and what you buy is used only once the month’s allowance is spent. Whatever is left of it does not expire when the month does.
• You can change or cancel a plan at any time from Settings, under Billing, which opens Stripe’s portal. Changing plan there charges or credits only the difference.

7. Acceptable use

You may not use Xyranik to send unsolicited messages to people who have not agreed to hear from you, to impersonate anyone, or to break the law. We may suspend an account that does, and will tell you why.

8. Limitation of liability

To the maximum extent permitted by law, FactoFlare AI is not liable for indirect, incidental, special, consequential or punitive damages, including loss of profits, data, use or goodwill.

9. Changes to these terms

These terms may change. We will tell customers of any material change at least 30 days before it takes effect. Continuing to use the service after that constitutes acceptance.
